What is an E-2 Visa?
The E2 visa is an investor visa issued by the United States government to people who come to the United States to start their own business.
Does the investment that I have to make for this E2 come directly from my bank account or from a company?
Both are fine. If you are an individual investing in a company in the United States, you must create a company account, then transfer money personally; or also transfer from a company account in Vietnam to a corporate account in the United States.
Would it be possible to transfer employees from abroad to work for the new US company if he/she performs well?
Yes, there are 3 programs that can be used to recruit people depending on the business model and business sector in Vietnam. It is the H-1B program for highly skilled employee, the L-1A program for senior management and finally the E-2 program to become a shareholder in the company, meaning that they are both employees and small shareholder in the company.
Currently, Vietnam is not a Treaty Country with United States, how can Vietnamese businesses and investors apply for E-2 Visa?
Unfortunately, right now Vietnam has no Treaty Agreement with the United States, so Vietnamese citizens will need to use a third country program that is in the treaty to invest in the United States. Investors will invest into this third country to get their new citizenship so that they can apply to E-2 to go to the US. The country that is about to become a treaty nation with the United States will be Portugal.
