What is a L-1A Visa?
A L1-A visa, is a visa used to transfer workers, or even the owner of your own company, from Vietnam to work at a company inside of the United States. And it is used only for executives and managers. In other words, high level corporate individuals.
What are the differences between L-1A Visa and L-1B Visa?
The L1B visa, is for highly skilled individuals. People who know information about the company that make them indispensable, hard to replace in a company.So for example, if you work for Coca-Cola, and you are one of the persons that knows the secret formula or the secret recipe, then that would make you eligible for the L1B visa. If you have intricate knowledge about the products of a company or the formulas, or the trade secrets, or if you are just very difficult to replace because of the knowledge that you have. Even if you are not an executive or a manager, but you are indispensable in your skills then, you would qualify for the L1B visa.
How to prove that I am a senior manager at the company?
You need to show at least the following: salary and labor contracts; organizational chart of the parent company to show how many people you are managing; last but not least is your qualifications (such as diplomas, training certificates, etc…).
If I am the owner of the company and do not have a payroll, would that make it difficult for L-1 records?
No. You can still prove your earnings using dividends to be shared each year to prove the equivalent of wages; withdraw money monthly as a salary; If you receive cash, you need to have a bank statements.
Are the parent company abroad and its subsidiary in the US required to be in the same business field?
For L-1B visas, it is not necessary to be in the same field because the only thing that matter is the applicant’s expertise that can be transferred to a subsidiary, but with L-1A, the parent company and U.S. subsidiary need to be in the same field or equivalent.
